<p>Washington, D.C., United States (AHN) &#8211; The U.S. Supreme Court upheld a 2008 decision that allowed patients to file a parallel claim against manufacturers of medical devices.</p>
<p> With the ruling, the court rejected an appeal by Stryker Corporation against a lawsuit foiled by Illinois resident Margaret Bausch who got a replacement hip six days after the Food and Drugs Administration (FDA) issued a warning about problems at Stryker&#8217;s manufacturing plant.</p>
<p> In seeking to dismiss Bausch&#8217;s lawsuit, Stryker cited a 2008 Supreme Court ruling that patients cannot file state-law product liability suits over products that went through FDA review.</p>
<p> However, a Chicago Federal Appeals court allowed Bausch&#8217;s suit based on the exception made the Supreme Court which allowed parallel claims.</p>
<p> The FDA investigated Stryker&#8217;s facility in Ireland and informed the company in March 2007 that it must correct manufacturing deficiencies. In 2008, Stryker recalled hip and knee replacements manufactured at its Ireland plant, including the one implanted on Bausch, requiring her to undergo a second surgery to have the defective device replaced.</p>
<p> Stryker, based in Kalamazoo, Michigan, reported last month that its profit went down 3 percent in the third quarter due to cost related to recent acquisitions. As a result, Stryker&#8217;s earnings went down to $327 million from $337 million after it purchased former rival Orthovita, the neurovascular business of Boston Scientific Corporation and Memometal Technologies, which makes foot and hand implants.</p>

<p>Marlborough, MA, United States (AHN) &#8211; The manufacturer of Publix Caesar Salad Dressing, Ken&#8217;s Foods, Inc. is recalling a limited number of 16oz Publix Caesar Salad Dressing bottles because it may contain undeclared fish, gluten and soy allergens. People who have an allergy or severe sensitivity to fish, soy and gluten run the risk of serious or life-threatening allergic reaction if they consume these products.</p>
<p> The dressing is 16oz. Publix Caesar Salad Dressing with an expiration date of 31MAR12 A. Bottles labeled correctly will have a UPC#4141500730. The product may have the incorrect ingredient statement for &#8220;Buttermilk Ranch&#8221; dressing. This dressing was distributed to Publix stores in Florida, Georgia, Tennessee, Alabama and South Carolina.</p>
<p> The recall was initiated after it was discovered a portion of the run contains an incorrect back panel label. This label does not list the presence of fish, gluten and soy.</p>
<p> As of this date, there have been no adverse reaction complaints reported relating to this recall.</p>
<p> As part of Publix commitment to food safety, they are asking customers to return the product to the place where it was purchased for a full refund or replacement. Consumers with questions may contact Publix at 1-800-242-1227, Monday through Friday 8:00am &#8211; 5:00pm EST.</p>

<p> Hazard: The red paint used on some bowling pins has been measured to be in excess of the maximum allowable level of 90 ppm, a violation of the federal lead paint standard.</p>
<p> Incidents/Injuries: G.A. Gertmenian and Sons, LLC has received no reports of incidents or injuries.</p>
<p> Description: This recall affects Toy Story 3 Bowling Game Rugs with a batch marking of JA 148. The recalled item contains six white plastic bowling pins with two red stripes painted on the necks, one black plastic ball, and a 68 inch x 26 inch nylon game rug with a print of the character Buzz Lightyear on the front. The batch marking JA 148 appears on the bottom front of the packaging just above the bar code, and is also located on the tag attached to the rug.</p>
<p> Sold at: Walmart Stores in the U.S. between September 1, 2010 and September 25, 2010 for about $18.</p>
